North Peak Widget Agreement

Between North Peak Digital Agency (hello@northpeakdigitalagency.app, “we”) and the operator of the Shopify store that activates the widget (“the Store”). This English version is binding.

1. Subject

We provide the Store with the North Peak widget: a script that shows social-proof badges (for example “5 people viewing now”, “84 views today”, “Popular”, “New”) on the Store’s product cards and product pages.

2. Real data only

Badges are based only on real data from the Store: live visitors, product page views, publication dates. If a condition is not truly met, no badge is shown. We never display invented numbers.

3. Affiliate links and payment

We are a publisher in the Store’s affiliate programme on Awin. On product cards that show a badge, the widget replaces the link to the product with our Awin tracking link that leads to the same product. A click on such a card is an Awin affiliate click. If it results in a sale, the Store pays the commission set in its Awin programme, through Awin, under Awin’s rules. The widget is otherwise free: there are no fees, subscriptions or other payments. Cards without a badge and the badge on the product page itself do not contain affiliate links.

4. Consent of the Store

By activating, the Store expressly allows us to show badges on its storefront and to use our Awin tracking links on product cards as described in section 3, including for the purposes of the Awin Publisher Code of Conduct. The person activating confirms that they are authorised to act for the Store.

5. Installation

The widget is installed by adding one line of code to the Store’s theme. The Store can do this itself, or ask us to do it. In the second case, the Store gives us collaborator access limited to themes. Before any change we duplicate the live theme as a backup; we add only the one line; we remove our access right after installation and tell the Store what was changed and how to undo it.

6. Data

The widget does not use cookies and does not collect personal data of shoppers. Details are in our Privacy Policy. Awin’s own cookies are subject to Awin’s terms and the Store’s own privacy information.

7. Switching off and termination

The Store can end this agreement at any time, without notice and without cost, by removing the line of code or by writing to hello@northpeakdigitalagency.app; we then switch the widget off for the Store. We can also switch off the widget or end this agreement at any time. Clicks made before the widget was removed remain subject to Awin’s cookie and validation rules, and commissions arising from them may still be paid through Awin.

8. No guarantee

We provide the widget “as is”. We do not guarantee any increase in sales or uninterrupted availability. If the widget is unavailable, the Store’s website keeps working normally.

9. Liability

To the extent permitted by law, we are not liable for indirect or consequential damage, lost profit or lost data. Liability for intent and gross negligence remains unaffected.

10. Changes

We may update this agreement. Each version has a date. A new version applies to a Store only after the Store accepts it again; until then, the version it accepted applies.

11. Law and jurisdiction

This agreement is governed by Swiss law. The courts of Lausanne, canton of Vaud, Switzerland, have exclusive jurisdiction.
